Ridesharing refers to any arrangement where privately owned vehicles are offered, for a fee, to passengers who request them. Uber and Lyft are the dominant ridesharing companies in Arizona, although other rideshare companies may also be available. 

In the state of Arizona, rideshare drivers are considered independent contractors. While Arizona law has certain conditions for operating a motor vehicle, Uber and Lyft have additional requirements. Generally, these include:

 

  • Being at least 19 years old
  • Having a valid Arizona driver’s license
  • Possessing vehicle registration and liability insurance on the vehicle used to carry passengers
  • Passing a criminal background check, and
  • Passing a driving history check

 

A person cannot be a rideshare driver if any of the following appear on their background check:

 

  • A conviction of a crime involving a vehicle in the last three (3) years
  • A conviction of a violent crime within the last seven (7) years and/or are
  • Registered as a convicted sex offender

 

Rideshare companies also stipulate certain requirements for their vehicles as well. Motor vehicles must have had a recent mechanical examination and must have at least four doors.

 

Impersonating a rideshare driver or driving under someone else’s rideshare account is strictly prohibited.

This is sometimes a difficult question. Depending on the circumstances of the accident, the Uber driver, the rideshare company, or even other drivers may be found responsible. Moreover, acts of negligence, total insurance coverage, and employment status at the time of the accident can also factor into who pays for your rideshare accident claim.

Arizona is what’s called an “at-fault state.” This means that the driver responsible for causing the accident will be liable for any damages. In an at-fault state like Arizona, you file a claim against the liable driver's insurance company, which covers your injuries and property damage.

Uber drivers in Mesa, AZ are not required to purchase their own commercial auto insurance policy specifically for rideshare driving. Arizona law requires that Uber drivers maintain a personal auto insurance policy that meets the state’s minimum coverage requirements. These include liability coverage of at least $25,000 for bodily injury to one person, $50,000 for bodily injury to two or more people and $20,000 for property damage per accident.

Arizona also mandates uninsured/underinsured motorist coverage at the same minimum limits.

When the Uber app is on, and the driver is available for rides or actively transporting passengers, Uber provides commercial insurance coverage on the driver’s behalf. This includes:

  • At least $50,000 per person, and $100,000 per accident for bodily injury, and $25,000 for property damage when the app is on but no ride has been accepted, and 
  • $1,000,000 in liability coverage per accident, as well as uninsured/underinsured motorist coverage and contingent comprehensive and collision coverage (if the driver carries these on their personal policy), when en route to pick up a passenger or during a trip.

While Mesa Uber drivers must have personal auto insurance that meets Arizona’s minimum requirements, they do not need to buy a separate commercial policy for rideshare work because Uber provides the necessary commercial coverage while they are working on the platform.
